Rethink Cross Exams in Traumatic Brain Injury Cases
I recently wrote an article for Trial, the official magazine of the American Association for Justice, entitled Rethink Cross Exams in Traumatic Brain Injury Cases. The article discusses the fact that mild traumatic brain injuries don’t have telltale signs, which will often times lead to a defense attorney using a medical expert to testify during trial that there is no objective evidence to support a client’s injury. However, I believe trial attorneys should not attempt to discredit the witness, but rather, should get that same expert to prove your case for you.
